So right now going to rag this year is looking pretty good! so i know at least a few of you lovely ladies and a select few handsome gents would like to get your photos taken by myself but can't because we live so far away.

so this year i am going to set aside time at every event i go to. to get these photos take!

The only money that would be exchanged would be a tip if the person thought it was satisfactory. Would that still require a merch liscense? I figure we would need one anyway because I also think that her doing unit and group shots for a small fee is an idea that may come to fruition.

This statement, to me, implies that she is expecting payment.  If money is to exchange hand at Rag at all, she does need to talk to either Simon or Galadriel (their words, not mine).

If she plans on doing this professionally, it would definitely be beneficial for you guys to look into getting a business tax ID.

I am pretty sure that FREE is a decent deal that shouldn't be out of anyone's price range... Hmm, guess the sarcasm didn't come through like I thought it did. Missing the can do that I guess.

So someone who is taking pictures of people for free but will accept tips for the work needs to sign up as a merch just because money MIGHT exchange hands? Just wanting to clarify.

Also,  she DOES have a bussiness ID since she IS a professional photographer with a bussiness. That was a bit of an assumption.

I am simply passing on what was told to me by Simon when I said another photographer was coming to Rag.  If you want stuff clarified, talk to him or Galadriel.  I didn't know what you meant by "merch liscence" which is why I suggested getting a tax ID.  I had no idea that this was a full on business already, so sorry for the assumptions.

I think what's confusing people is the statement that tips are welcome makes it sound as though you're encouraging people to tip you (rather than risk them not thinking of tipping because you didn't nudge them ahead of time), which might seem to some like a runaround of the merchanting restrictions (which are there to comply with the campground's insurance requirements, among other things).

Well I think the merchants row regulations should still apply, if for no other just out of decency guys....

Merchants have to jump through a lot of very expensive loops to set up shop at Rag now that it is at Coopers Lake.  A lot as in several hundred dollars worth of red tape.  Those who (and I'm not saying by any means this is the case here, please no hating... lol) avoid those regs by doing some business, whether is it for tips, which still is a business consideration of $, or are traveling ware sellers are doing your merchants who follow Coopers Lake rules and Penn law a disservice.  It's not really very fair, IMO.

There is already a person in Merchant Row who does photography.  If you want to do photography as well you must submit a proposal to me for approval and have all the Merchant ID's and Insurance in order as per both Ragnarok rules and Cooper's rules... It does not matter if you are charging or not you must register as a merchant and follow their guidelines including getting the insurance and approval to operate at Ragnarok.

You would still be paying for a service performed at Ragnarok, yes?  If it was something that she had offered you and you alone, and was only doing it the one time, there would be less issues.  However, she is advertising to everyone and the nice lady in charge of Troll (and merchants) has spoken.

Stop trying to buck the system, either be a legit business and pay the fees and set up a shop, or don't sell anything.  This isn't hard, you are not special, either play by the rules or don't play.

That seems a little much to me. To be a merchant you must actually sell something, by law, accepting tips/donations does not make you a business. You have to actually charge for the service to be a business.

If you ask for tips before/after providing a service and advertise said service, you are soliciting for payment, which classifies you (very loosely) as a business.

In other words, if you're planning on doing something free, hoping for tips, just don't advertise the fact.

Come on man, really?  You are way to smart to play this game...  I know what you're saying, and if you take a step back you know what we're saying.

There are people who want to take pictures for the love of taking pictures, and for everyone's enjoyment, that's awesome!  Then there are merchants who run a fo'real business taking pix.  Then there are people who want to make money out of their camps while bucking the system that everyone else went through to make this a successful event.  We deal with it every year, and it's ****ing lame.

We have this problem with garb all the time as well.  We have people who paid us lots of money to set up their store on site to make garb.  There are multiple garb merchants, and there can be more.  But then we have "punk mofo George" every year who owns a sewing machine and tries to sell garb out of their camp...  It's the same thing.  Don't **** on our merchants who make the event awesome by fronting us a ton of money to use to buy stuff by undercutting them, join them and be a grown up.

In the real world you can't set up an ice cream stand in Baskin Robins' parking lot either.

I feel dumber for actually having to explain this to a group of people over the age of 18 who I assume passed high school...  Maybe my assumption is the problem...  Umption's a real *******.

Come to think of it, there is a precedent. There was a photographer that came out to a few Rags (around Rag 18ish?) who put his photos through the week in a book you could flip through and buy the prints. He didn't set up a booth, he just kinda wandered around. What did Troll do in his case? Or was he on the DL?

At Rag 18 we had well under 900 people.  The event now has about 1500+ people, and deals with amounts of money and legal ramifications that do not allow for a case by case basis of treatment any more.  The event now is almost unrelated to that one.  There are new rules made every year based on things that happened last year and the year before and the year before.  It was legal to drink and drive in the 50's, so what?

I have been thinking about this and have come up with a solution.
Take the pictures as planned.
Wholesale or put them on consignment to one of the paying Rag photographers.

You get some money (tips).
And you help our Rag vendor make more money as further incentive to come back next year.
Rag gets a loyal vendor we can count on for next year which reduces attendees costs.

EVERYONE WINS!!
This is the most philanthropic way to go about this great idea.

BH has it right that consignment is always an option. That is how Jari and I operate, since we have neither the desire or means to run our own merch booth. We find someone willing to sell our stuff, and they get a cut of the sales. It's worked quite well for us....and hopefully for our consigners, as well.

We are trying to make a larger and larger event, simpler and simpler to run, so leaving it as it is now, would be preferable.  Consignment seems to have worked up until now, until it doesn't I'd say precedent has been set.  But that's just my view from Security, it doesn't count for more than me thinking out loud...  Which we all know isn't much!

I think the organizers are trying to avoid the slippery slope, that's all...  I'm sure this will all be worked out so everyone is happy and has a great time!  At least I hope so!

I think Oni has a great idea, further, I am so very happy she is doing this for purely altruistic reasons. But jumping through various hoops and careful language choices, in order to avoid fees gives the appearance of impropriety. I have been to countless events (Dag, church, farms, ect..) where the cost of things is labeled "donation" or "Tips", we (those of us with 2 brain cells left) are fully aware of the reasons this is done. I have watched event staff and people known as secret shoppers visit these establishments in order to test this "donation/tip" with horrifying results. Why would someone put themselves in a position that could result in a legal tangle when there is a truly altruistic (and legal) way to accomplish their goal? See my earlier post.

Soo - stop feigning ignorance of this fact, we are on to you. No one is as stupid as you are pretending to be.

PS. It might be time to wait for Oni to speak for herself on the matter, instead of people trying to put words in her mouth.

Soo, if you're not going to attend, why do you care?  If you did, or looked at the rest of the issue, you'd find out that Dagorhir and Ragnarok aren't imposing these rules and licensing requirements, the campground is.  They require that businesses, even temporary ones that are going to operate there do so in compliance with Pennsylvania state laws, laws that are better geared for permanent businesses than the kinds of things we do.  Hence the hoops and costs that several people have mentioned. 

I too remember the days when Ragnarok was simpler - I even remember when our first merchant showed up.  Boy that was a surprise.  And she came back, and over time more merchants came, offering more wares, year after year.  Now with the new site, we’ve got added rules and costs, yet somehow we’ve got even more merchants offering more stuff.  Correct me if I’m wrong, but there were something like 20 merchants last year (some via consignment, others sharing booths, etc.).  Sure some were Pennsic folks opening early, but others have been with us for years. 

So while there’s always going to be someone selling off some spare weapons or garb on the side, there is a fine line (or slippery slope) between that and evading the campground’s rules.  And let’s be honest, their rules are mostly about having insurance so that they’re not sued, and complying with onerous state laws (so they’re not charged with tax evasion or whatever).  And we, by attending an event there agree to work within the site's rules.

You guys are right. I am wrong. Whatever. I know what a business is, because I run one. I know what donations are because I take them, outside of my business. Taking donations does not make you a business, by law. Saying Donation=5$ does. Because then you are charging, not accepting whatever someone wants to give, even if it's nothing. All I am saying is it seemed to me that she posted ligitimately an offer to do free work, since she was already planning to do so for other people, and now she is being told she's a business. IMO, she was not trying to undercut an established merchant, simply saying if anyone else wants their pictures taken by her...for free...she would do it.

Why do I care...because it seemed like a friend of mine was being judged unfairly for doing something just about anyone with a camera would do. For doing something people have done for years with weapons, gear, food, drink, garb and what have you.

Also I would go to Rag, if I could guarentee that one particular person woud not be there. Because if that person were to be there, and he is every year, I will get myself kicked out for being a jerk. Just wanted to say where I was coming from. Like I said, you all do what you will. I just think she was judged unfairly, that is all.

Dude, I think what you may be missing is that she runs an actual photography company and advertised her services as such, not just some person taking the same stupid amount of pictures as everyone else...  We all know and respect Lady Oni's mad photo skills, her company (Resident Rockstar) takes some pretty bitchin' pix.  But if you can't see how that is a hard sell to our photo merchant, who paid a lot of deniero to be a merchant at Rag, well...  I'm not sure I know how to explain it any better to you my friend.

I'm sorry man, but depending on where you are, you would be breaking numerous laws.  There are plenty of cities now that explicitly ban performing with out application for certain types of permits to limit panhandling...  'Cause, you know, the homeless are the enemy?  But whatever...  I don't really care enough to get into that.

Totally right Hive...it's really juvenile, and I am almost embarrassed that I feel that way. It's the only person in the whole world I would fight on sight. I am normally not a grudge holder, nor a person who seeks a fight, but i just can't seem to get over this one, and the person I have it against is a fairly well known personage of Dag. I wouldn't risk travelling 30+ hours to a week long event, only to get kicked out in the first five mins because i was introduced to the wrong person right off the bat.

As far as Oni's issue, that's for her to deal with, I made my point, whether it was right or wrong. I am done commenting on that. It's between her and the Rag. peeps now.
